This Pre-Transaction Information Text for One-Time Payment Transactions ("Text") is signed between PayPorter Payment Services and Electronic Money Inc. ("kuikpara"), which has been authorized by the Central Bank of the Republic of Türkiye to operate as a payment and electronic money institution under Law No. 6493 on Payment Services and Electronic Money Institutions (the "Law") and the relevant legislation, and the payment service user ("User", "Customer") for the purpose of executing the payment transactions and services specified below.

This information text is provided in accordance with Article 30/2 of the Regulation on Payment Services and Electronic Money Issuance, Payment Institutions, and Electronic Money Institutions.

Definitions

Recipient: The individual or legal entity to whom the funds subject to the payment service are intended to be transferred.

Receipt: A written acknowledgment that is automatically generated by the system after the collection transactions performed by the Representative in the payment services, in a format, content, purpose, and manner of use determined by the Payment Institution in accordance with the Law and regulations, and which does not replace a voucher, invoice, etc., under the Tax Procedure Law and related legislation.

EFT: Electronic Fund Transfer provided through contracted Banks and executed via PorterSystem.

Account: The account opened with kuikpara for holding Turkish Lira (TRY) and Foreign Currency (FX) in accordance with the Payment and Securities Settlement Systems, Payment Services, and Electronic Money Institutions Law.

Customer/User: The individual who benefits from kuikpara Services.

Payment Services Law: Law No. 6493 on Payment and Securities Settlement Systems, Payment Services, and Electronic Money Institutions, dated 27/06/2013.

Payment Order: The instruction given by the User for the completion of the payment transaction.

kuikpara Services: All products and services that can be provided under Law No. 6493, including domestic and international Bank and Payment Service Provider fund transfers, bill payments, EFT payments, and future additions or removals to PorterSystem in cooperation with kuikpara and integrated with PorterSystem.

PorterSystem: All software and/or hardware applications that transfer information regarding the kuikpara Services to kuikpara’s information system, authorized by kuikpara, and produce information and documents related to kuikpara.

Regulations and Announcements: Regulations and announcements prepared by the relevant authorities based on the Payment and Securities Settlement Systems, Payment Services, and Electronic Money Institutions Law No. 6493, dated 27/06/2013.

3. Information to be Provided by the User

In accordance with Article 29 of the Regulation on Payment Services and Electronic Money Issuance, and Payment Institutions and Electronic Money Institutions, the following information must be provided to kuikpara by the User in order for payment transactions to be carried out:

4. Transaction Completion Time

4.1 For domestic IBAN transfers:
Transactions made on business days until 16:30 will be completed on the same day. Transactions made after 16:30 or on non-business days will be completed within the EFT hours on the next business day.

4.2 For transfers made through our domestic payment points to foreign countries,
The funds will be available for the recipient’s use within 10 minutes in the system. These times reflect the duration required for the payment amount to reach the Recipient's Payment Service Provider. All responsibility for ensuring the payment reaches the Recipient lies with the Recipient's Payment Service Provider.

5. Fee Information and Fee Breakdown
The following information is provided to the User before the transaction is completed with kuikpara, and the User’s consent is obtained. The Transaction Fee/Cost is provided to the User by the system before the transaction is initiated.

6. Exchange Rate/Reference Exchange Rate Information
In addition to the transaction commissions charged during payment transactions, kuikpara also generates income from exchange rate differences when currency exchange is applied to transactions. For transactions requiring currency exchange, the exchange rates determined by kuikpara will be applied, and the Customer will be informed before the transaction.

7. Accuracy of Payment Transaction and User Declaration Information

7.1 The User acknowledges and declares that all information provided by them related to the payment transaction (including all information provided regarding the Recipient) is accurate, and that any direct and/or indirect loss arising from incorrect or incomplete information will be their responsibility.

7.2 If the information provided by the User is incomplete or incorrect, kuikpara cannot be held responsible for the failure to complete the payment transaction or for any errors in processing the transaction.

7.3 The final response to any Requests and/or Complaints regarding your payment transactions will be provided within 20 days from the date the request is received.

7.4 The User acknowledges, declares, and undertakes that under this agreement, they are acting on their own behalf and for their own account with the products and services offered by kuikpara, and that they are not acting on behalf of another person. If they are acting on behalf of another person, they undertake to immediately and in writing inform kuikpara of whose account they are acting on, along with the identity details of that person, in accordance with Article 15 of Law No. 5549 on the Prevention of Laundering Crime-Related Assets and the Regulations on the Prevention of Money Laundering and Financing of Terrorism.

7.5 The User undertakes and declares that, in accordance with the Regulations on the Prevention of Laundering Crime-Related Assets and the Financing of Terrorism published by the Ministry of Finance of the Republic of Turkey, which came into effect on 01.04.2008, the identity documents and other documents they present, as well as the information on the Payment/Transfer Form, are accurate and complete. They also undertake to compensate kuikpara for any damages arising from the misinformation or incorrectness of these documents. Furthermore, the User declares that the funds they have deposited or will deposit are not “criminal proceeds” under Article 282 of the Turkish Penal Code, and that the funds were not obtained through actions that constitute Money Laundering Crimes.

8. Authorization of the Payment Institution

8.1 The Payment Institution is deemed authorized to carry out the transaction when the instruction for the payment transaction, given by the User to the Payment Service Provider, is received by kuikpara.

8.2 The User is fully responsible for all outcomes of the Payment transactions carried out in accordance with the Payment Order they have provided.

8.3 The User cannot make any claims for damages in these cases and cannot make any requests against kuikpara.

9. Payment Document

9.1 In accordance with the second paragraph of Article 29 of the Regulation, a copy of the Receipt will be delivered to the User for payment service transactions conducted at our service points.

9.2 For one-time payment transactions made via remote communication tools, a copy of the text containing the payment service user's approval will be provided to the User on paper or via a permanent data storage medium.

10. Protection of Information and Unauthorized Use

10.1 Personal security information related to payment instruments issued by organizations, such as passwords, security questions, certificates, encryption keys, PIN, card number, expiration date, CVV2, CVC2 codes, which can enable fraud or fake transactions on behalf of Users if intercepted or altered, is considered "Sensitive Payment Data." Sensitive Payment Data and other information shared by the User during a transaction are stored and used for the purpose of providing payment services and managing related operations.

10.2 This information may be shared with necessary parties, such as kuikpara's business partners, correspondents, billing institutions, etc., who are required to complete the transaction.

10.3 The User acknowledges and declares that in case of suspicion of fraud and/or unauthorized use, or at the request of competent public authorities, their information may be shared with judicial and/or administrative authorities and/or official institutions.

10.4 The User agrees and declares that they will take necessary precautions to protect the payment transaction information (reference number, recipient details, etc.) and prevent its sharing with third parties. In the event that the information is not protected by the User or due to the User's fault, resulting in a fraudulent or unauthorized payment transaction, the User agrees and declares that any direct and/or indirect damages arising from such transaction will be their responsibility.

11. Reversal/Refund of the Payment Transaction and Transaction Fee/Cost Refund Criteria & Process

The User cannot cancel the Payment Order given to the Payment Institution without the Payment Institution's consent. In this regard, with this text, the User agrees and undertakes that they can cancel the Payment Order according to the criteria outlined below. kuikpara reserves the right to make unilateral changes as per this article.

Transaction Fee/Cost Refund Criteria:

11.1 For transactions to be canceled on the same day, the fee refund is not subject to approval. The fee will be refunded unconditionally.

11.2 No fee refund is made for the return of EFT transactions.

11.3 If a transaction is not visible in the system or cannot be processed due to technical errors, the fee refund is subject to approval.

11.4 In case of issues at the payment points, efforts will be made to resolve the problem first. If the problem cannot be resolved, action will be taken based on the nature of the issue.

11.5 If the payment point informs the recipient that kuikpara is not an agreement partner, the User will be offered an alternative institution for the transaction. If the User accepts the alternative institution or no alternative institution is available, the fee will be refunded. Otherwise (if no alternative institution is available or the User does not accept the alternative), no refund will be made.

11.6 If the payment transaction is rejected due to exceeding the payment limit at the payment point, the customer will first be directed to a nearby point where the payment can be made. If there is an alternative nearby point and the customer requests a refund, the fee will not be refunded. If no nearby point is available, the fee will be refunded.

11.7 If none of the offices of the partner institution has the authority to make a payment, and if no nearby payment point exists, the fee will be refunded.

11.8 If the refund is due to a User error, such as a wrong country, incorrect amount, etc., the fee will be refunded.

11.9 If the payment transaction is rejected by kuikpara’s Compliance Department due to compliance/blacklist checks, the fee will not be refunded.

11.10 In cases where the payment is not made due to a mistake in the recipient’s name, efforts will be made to correct the issue and process the payment. If the customer does not request a correction and asks for a refund, the fee will not be refunded.

11.11 In name-based transfer transactions, the fee will be refunded for refund requests due to name, country, or amount changes, on the condition that the transaction will be repeated. If the transaction will not be repeated under the conditions mentioned above, the fee refund is subject to approval.

11.12 Payments not received by the recipient within 30 business days will be refunded without a fee.

11.13 No fee refund will be made for EFT transactions sent to a bank account or credit card in Turkey and returned by the recipient’s bank for any reason.

Transaction Fee/Cost Refund Process:

11.14 The customer can request a fee refund via the call center, representatives, or branch channels.

11.15 If the request is made via the call center, the status of the transfer will be checked. If it has not yet been paid to the recipient, the customer will be directed to the nearest payment point where they can initiate a refund.

11.16 A cancellation request can be initiated the same day as the transfer date as long as the recipient has not withdrawn the money.

11.17 A payment transaction cannot be canceled on a different date from the transaction date; the refund process will be initiated from PorterSystem.

11.18 For EFT and credit card transfers, a cancellation/refund request can be initiated if the EFT transaction has not yet been forwarded to the intermediary bank. EFT and credit card transfers already forwarded to the intermediary bank cannot be canceled.

11.19 When initiating a refund process from representatives and branches, the appropriate option, either with or without fees, will be selected and initiated in the explanation field.

11.20 The Operations Department will evaluate the refund request in accordance with the institution’s definition forms, operating conditions, and restrictions.

11.21 Depending on integration, the refund request can be submitted via email to the institution.

11.22 Fee refunds are evaluated according to kuikpara’s Fee Refund Procedure. If they do not meet the criteria, they will be rejected.

11.23 If the request is not transmitted from the system due to the integration method, the institution will be informed once the refund is processed.

12. Intellectual Property Rights

The User agrees and undertakes not to copy, reproduce, modify, distribute, or create derivative works from any elements related to intellectual property rights, such as the title, business name, trademark, patent, logo, design, code, information, and methods, whether registered or unregistered, found on the Payment Institution’s website or other documents, and not to infringe upon any such intellectual property rights in any way.

13. Authorized Court

With this text, the User declares that they are competent to carry out the transaction mentioned above and agrees to conduct the transaction in accordance with the information and terms stated above.
